Right of withdrawal
Last updated:
For private customers (consumers). Business customers have no right of withdrawal; they can cancel monthly.
Your right of withdrawal
You have the right to withdraw from your SparkHost rental contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the contract was concluded, which is the day your first payment was received.
To exercise the right of withdrawal, you must inform us — SOHO ICT B.V., trading as SparkHost, Keizersgracht 555, 1017 DR Amsterdam, the Netherlands, email support@sparkhost.ai — of your decision by a clear statement. The easiest way is the “Withdraw” button on your portal dashboard (shown during the 14 days); you can also email us or use the model form below, but you don't have to. To meet the deadline, it is enough that you send your withdrawal before the withdrawal period has expired. We confirm receipt by email.
Effects of withdrawal
If you withdraw, we refund all payments we received from you, including the setup deposit, without undue delay and at the latest within 14 days from the day we were informed of your decision. We use the same means of payment you used, unless you expressly agreed otherwise; you will not incur any fees for the refund.
The setup deposit (€500 per unit excl. VAT, €605 incl. 21% VAT) is non-refundable (except if you withdraw within the 14-day withdrawal period). Withdrawal is the only case in which you get it back; after the withdrawal period it is not refunded, also not when you cancel or the rental ends.
At checkout you asked us to start the Service immediately, during the withdrawal period. You therefore pay an amount proportionate to what was provided until you informed us of your withdrawal: the monthly price pro rata for the days the Service was provided. We deduct that amount from the refund. We then stop the Service, cancel the subscription and wipe the storage of the unit(s).
The rest of our terms for private customers are in the consumer section of the Terms of Service.
